About the Notary public Torrox-Costa. Not all countries have a notary to verify documents as they do in Spain. Here the Spanish notary is a very much respected individual whose office carries a clearly recognised ‘Notary’ sign and who trains for several additional years to qualify for the title.
Most people associate the notary with Spanish power of attorney but their activities go much further than that.
The notary is a professional within the Spanish law system and his/ her main function is to certify Spanish documents ensuring that private agreements fulfil certain legal criteria. The Spanish notary is involved in legalising agreements and contracts and uses a stamp and signature to endorse them.
The main difference between a Lawyer and a Notary is that the Lawyer deals with private documents such as contracts and might represent a client, for example in a law-suit. A notary, on the other hand, brings a document into the public domain.
The notary has a strict code to abide by and the Law for Notaries defines his function and the extent of his or her authority. The notary is qualified to a very high level and must pass some very strict exams to achieve this status. They must study initially for five years at University to obtain their lawyers’ degree. They then pass an additional competitive examination which requires, on average, another three to five years of preparation.

Notaries are an important regulator who can guarantee that the documentation in Spain is correct and would be considered authentic and proven in court. Any document that needs to be entered in a registry, such as the land registry has to be signed in front of the Notary.

The notary isn’t always stuck in the office. They will sometimes be called out to complete a particular service such as being called to hospital to enable a seriously ill person to make a will. They are often present at some very important times in people’s lives. For example, when there is a transfer of property or a company is being formed and needs a constitution.
It might not be a role that we are familiar with in other European countries but the notary carries a great deal of respect in Spain.

De Nederlandse huisarts in Nerja Dr. Rik Heymans is geboren in Dendermonde, Vlaanderen, België, waar hij aan de Abdijschool de Latijns-Griekse humaniora volgde. Hij behaalde zijn medische dokterstitel in 1987 aan de Katholieke Universiteit van Leuven en deed zijn militaire dienst als onderdeel van de NAVO-troepen in Duitsland, gelegerd langs de grens met Oost-Duitsland.

Gedurende 10 jaren werkte Dr. Rik Heymans hij in het Universitair Ziekenhuis van Pretoria, en was er docent en Hoofd van Spoedgevallen en Polyklinieken afdelingen. Hij behaalde daar zijn Masters (Specialist) graad in de Huisartsgeneeskunde, en deed uitgebreide ervaring op in chirurgie, cardiologie, en oor-neus en keel ziekten. In 1998 verhuisde Dr. Rik Heymans met zijn vrouw, Karen, naar Nerja.
Tijdens zijn jeugd bracht zijn familie de meeste zomers in dit prachtige deel van de Costa del Sol door,dus de keuze om zich in Nerja te vestigen was duidelijk voor de hand liggend…
De kliniek begon in April 1998 in hun privé-huis, met de tuin als wachtkamer! Het was de meest ontspannen en zeker een van de meest ongewone wachtkamers in Europa, met patiënten met hun gezinnen zittend in de schaduw, met katten en honden om hen te vermaken!
Na de geboorte van hun zoon Hendrik in 1999 werd het snel duidelijk dat de druk van een 24-uurs kliniek niet echt meer verenigbaar was met een familiehuis, zodanig dat dus een nieuwe kliniek in Calle Angustias, 24 werd gebouwd, waar Dr. Rik Heymans nog steeds zijn patiënten ontvangt.

Het Spaans behoort tot de meest gesproken talen ter wereld. Naast Spanje zijn – met uitzondering van Brazilië – het hele Zuidamerikaanse en Middenamerikaanse continent Spaanstalig. Wij Nederlanders en Belgen doen vanouds zaken over de hele wereld en komen regelmatig in gebieden waar het Spaans de voertaal is.
Ik ben reeds lange tijd woonachtig in Spanje en heb voorheen ook in Zuid-Amerika gewoond en gewerkt. Wat mij blijft verbazen is het feit dat veel Spaanstalige mensen in welk land maar ook een op zijn minst gezegd redelijke taalachterstand hebben ten aanzien van het Engels. En in mijn vorige beroep als makelaar in onroerend goed ontdekte ik dat Nederlanders en Belgen inderdaad een aardig woordje over de grens spreken maar dat ze er desondanks graag voor kiezen om in formele situaties een tolk of vertaler in de arm te nemen.
Vanuit professioneel oogpunt raad ik een ieder aan dit absoluut te doen. Werk met de allerbeste professionals en vergewis u ervan dat u elk woord, elk detail in een bespreking of in een contract verstaat en begrijpt. In Spanje zijn in de onroerendgoedsector door de jaren heen nogal wat situaties ontstaan die uiteindelijk resulteerden in hoge boetes, netelige omstandigheden en in het ergste geval gedwongen sloop van een woning.
Weet u dat veel van deze situaties voorkomen hadden kunnen worden? Simpelweg door een professionele tolk – vertaler te contracteren die ook nog eens de nodige ¨bagage¨ heeft om u te adviseren? Door een snelle tolk – vertaler met een zorgvuldig opgebouwd netwerk te betrekken bij uw formele handelingen?
